City of Vancouver Public Wi-Fi

The City of Vancouver (“City”) provides public Wi-Fi for internet access on your personal device (“WiFi”) in many of its facilities (“City Facilities”) as a convenience to you, subject to certain expectations regarding your WiFi use. Please review the below WiFi Terms of Use, which cover the City’s expectations for your WiFi use. If you agree to use the WiFi in compliance with these expectations please click “Agree” below the expectations, referred to as terms of use (“Terms”) to connect to the WiFi. You may also review these Terms on the City’s website. You may choose not to agree to these Terms; however, you may access the WiFi only if you agree to comply with the Terms.

Public Wi-Fi Terms of Use

Please review these Terms before clicking Agree (or opting out of WiFi access because you do not want to agree to them). These Terms contain a section that limits the City’s liability to you in all caps in Section 8, below.

  1. Availability. The City makes WiFi available as a convenience to you in certain City Facilities. WiFi may be unavailable at any time, without notice to you. The City makes no promises that you will be able to access or use the WiFi in any City Facilities or that the WiFi will maintain any particular speed or quality.
  2. Access. The City may limit, terminate, or prevent your access to the WiFi for reasons such as: a violation of these Terms or any federal, state, or local law, your actions that could lead to liability for the City, WiFi unavailability, or for other technical or security reasons.
  3. Security. The City’s WiFi may not be secure. The City makes no promises to you regarding the security of the WiFi. It is possible that your data could be viewed or intercepted by a third party, not transmitted, or otherwise interfered with during your WiFi use. Do not use the WiFi to transmit or receive unencrypted or plain text data. If you send or receive unencrypted or plain text data using the WiFi, you do so at your own risk and you also violate these Terms.
  4. Filters. The City applies filters to prevent access to malicious or explicit content while connected to the WiFi but provides no parental controls or other age-specific controls and makes no promises to you regarding the content of any website accessible while using the WiFi. Limited filtering may not filter all malicious or explicit content. The City has no control over third-party websites and you accept all risk related accessing any website while connected to the WiFi.
  5. No Public Forum. The City’s public WiFi is not a public forum, a limited public forum, or a designated public forum.
  6. No Reasonable Expectation of Privacy. You have no reasonable expectation of privacy while using the WiFi. You agree that the City may monitor your WiFi usage. The City logs websites as part of its filtering process.
  7. Prohibited Activities. You are prohibited from using the WiFi to engage in any of the following activities:
    a. Reproducing, retransmitting, or attempting to sell access to the WiFi;
    b. Agreeing to these Terms on behalf of another person, unless you are agreeing to these terms on behalf of a person under the age of 18 for whom you are authorized to agree;
    c. Accessing any computer or network without authorization from the third-party who has authority over that computer or network;
    d. Attempting to perform a penetration test or any other security test;
    e. Sending SPAM communications;
    f. Engaging in malicious activity such as introducing viruses or trojan horses into any system or any other technical circumvention measure or any action that interferes with, disrupts, harms, or damages any person, City Facilities, or any City-owned or licensed property;
    g. Engaging in unlawful actions, such as fraud or infringing on any City or third party right, including intellectual property rights. Unlawful actions may subject you to civil or criminal liability.
  8. ASSUMPTION OF RISK; NO WARRANTY; LIABILITY DISCLAIMER. YOUR USE OF THE WIFI IS AT YOUR OWN RISK. THE CITY PROVIDES PUBLIC WIFI “AS IS” AND “AS AVAILABLE.” THE CITY MAKES NO WARRANTY OR GUARANTEE TO YOU REGARDING THE AVAILABILITY OF THE WIFI, THE FUNCTIONALITY OF THE WIFI, THE PRIVACY OF THE WIFI, OR THE SECURITY OF THE WIFI. THE CITY DISCLAIMS ALL LIABILITY RELATED TO YOUR WIFI ACCESS OR INABILITY TO ACCESS THE WIFI, WHICH MEANS THE CITY WILL NOT BE LIABLE TO YOU FOR ANY DAMAGES RELATED TO YOUR USE OF THE WIFI, INCLUDING ACCESS, PRIVACY, OR SECURITY, OR INABILITY TO USE THE WIFI. IN NO EVENT WILL THE CITY BE LIABLE TO YOU FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, LOSS OF DATA, LOSS OF BUSINESS OR OTHER LOSS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE CITY’S PUBLIC WIFI, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF CITY HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES. TO THE EXTENT CITY MAY NOT DISCLAIM ALL LIABILITY TO YOU, THE MAXIMUM LIABILITY IT WILL HAVE FOR ANY CLAIM BROUGHT BY YOU UNDER THESE TERMS IS $100.
  9. Choice of Law. These Terms are governed under Washington law.
